1: Payments: Online payments on this site are collected via credit card through our trusted processors. Cash and checks are also accepted in person. No payments will be accepted for amounts exceeding purchase price. We reserve the right to inspect your government issued photo identification for check and credit card transactions.
2: Refunds: All sales are final, however, we honor a 100% satisfaction guarantee. If your prints or products are not up to quality standards, we will reprint or replace at no cost to you. Quality standards are defined as follows: Skin tone is a believable color rendition and lifelike in representation; Shadows contain visible detail, when appropriate; Highlights have visible detail and are not blown out (except for areas of all white, which may not show detail); photographs do not have any unnatural color cast, and are sharp, and in focus. If we are unable to provide a print that meets the aforementioned quality standards, either due to negligence, camera malfunction, other equipment malfunction, we will offer a similar image or product of equivalent value. In rare and unique circumstances, a refund may be offered to remedy an issue, at the sole discretion of the Photographer.
3: Limited model release for purchasers: Your right to use this Site and personal license rights (when so granted), are conditional upon your acceptance of these terms and conditions. For valuable consideration received by obtaining photographic products or images made by the Photographer, I (the purchaser, either on my own behalf, or on behalf of my minor child appearing in photos taken) hereby grant my irrevocable permission for the photographer to use the images that he/she has taken or may take in the future, to use in any and all formats now or hereafter, including print, online, and for any purpose whatsoever. This authorization and release shall also inure to the benefit of the heirs, legal representatives, licensees, and assigns of Photographer, as well as the person(s) or entity for whom he/she took the photographs, if photographer was hired by a third party. I am a legally competent adult and have the right to contract in my own name. I have read this document and fully understand its contents. This release shall be binding upon me and my heirs, legal representatives, and assigns.
4: Ownership of Copyright: The photographer is the sole owner of the copyright of all photos taken. Unless you have specifically received such permission in writing from the photographer, no purchase of prints or products shall carry any license to reprint, edit, reproduce, or copy in any other way, any print or image from this website.
5: Digital Downloads: Downloads are not always offered. When this option is available, downloads are delivered via website only. Instructions will be provided during the checkout process or immediately following purchase. When purchasing Digital Downloads, you will receive a limited copyright release. This release does not change the ownership status of the images, it only grants you the right to use the image(s) for personal use. The terms and conditions are very specific and are included in the download package. You are encouraged to read the terms when downloading. Downloads do not include any physical delivery (e.g. a DVD or USB stick). It is strictly internet-based delivery.
6: Delivery Time Expectation: All of the photos taken will be made available on this website as quickly as possible. Orders submitted and paid for through the website can take up to 3 weeks for delivery. If you would like something sooner, please include your request in the notes field. Video productions may take approximately 8-10 weeks (for production program material of less than 30 minutes), or up to 12 weeks (for production content of program time greater than 30 minutes). You will be notified when your items have shipped.
7: Shipping: A small shipping fee is charged and covers packing and shipping your order to you. Non-bendable items, and all orders over $50 are sent via a traceable method (USPS Priority or similar), Orders up to $49.99 are sent via USPS First Class, unless prohibited by the size of the products ordered. Additionally, photos ordered through a partner site may carry different shipping terms and prices.
8: Video quality: Some of our video productions are shot in very low light. We exercise our best efforts to keep the subject matter well lit and in focus at all times, however, accurate camera focus depends on contrast, which depends on being able to differentiate light from dark. When the program is in near or complete darkness, you may see the camera move in or out of focus as it tries to locate the focus point. We strive to avoid this, but sometimes it is inevitable. We regularly work with event producers to ensure our camera placement and lighting choices are always optimal, but we don’t always find ourselves in ideal circumstances. Trust that we are doing our best with what we have available to us in terms of lighting and camera position.
9. Partner sites: For some of our photo shoots, we may opt to utilize a third party hosting site for image gallery hosting, online shopping, and checkout. When using a partner third party, you must also agree to the site-specific terms and conditions, which may include a biometrics policy and/or separate terms.
